TERMS OF SERVICE
Welcome to ComparaHome (the "Site"), operated by Optilabx ("we," "us," or "our"). By accessing or using the Site or any services offered through it ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the Site.

1. Acceptance of Terms
By using the Site, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a binding agreement between you and Optilabx. If you are using the Site on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
ComparaHome is a lead-matching service that connects consumers requesting pest control quotes with independent, licensed pest control providers in our network of marketing partners. We are not a pest control company. We do not perform pest control services. Any services you hire are provided directly by the independent licensed contractor you choose to engage.
The Site enables you to:
- Submit a quote request by providing information about your pest issue, property, and contact details;
- Be matched with one or more of our marketing partners, who will contact you to provide a quote or further information;
- Compare quotes and choose whether to engage any matched provider directly.
We do not charge you for use of the Site or for being matched with a provider. You pay only if you choose to hire a provider, and any fees are set by and payable to that provider, not to us.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use the Site. By using the Site, you represent that you meet these requirements. If you are submitting information on behalf of a household or property, you represent that you are authorized to do so.
4. User Conduct
When using the Site, you agree that you will not:
- Submit false, inaccurate, or misleading information;
- Submit information about another person without that person's permission;
- Use the Site to submit requests for anyone other than yourself or a household you are authorized to represent;
- Use the Site for any unlawful, fraudulent, or abusive purpose;
- Interfere with or disrupt the Site or its underlying infrastructure;
- Attempt to gain unauthorized access to any part of the Site or related systems;
- Use automated means (bots, scrapers) to access or submit through the Site;
- Copy, reproduce, or redistribute any content from the Site without our prior written consent.
5. Accuracy of Information
You agree that the information you provide through the Site, including your name, email address, phone number, ZIP code, and details about your pest issue, is accurate, complete, and current. We rely on this information to match you with appropriate marketing partners. Inaccurate information may result in inability to fulfill your quote request, or in our marketing partners contacting the wrong party. You are responsible for ensuring the phone number and email you provide are yours, and that you have authority to receive communications at them.
6. Third-Party Services and Marketing Partners
When you submit a quote request, you consent (via the TCPA consent checkbox on the form) to be contacted by the marketing partners listed in the Marketing Partners section of our Privacy Policy. These partners are independent businesses. We do not control, and are not responsible for, their services, their employees, their quotes, their pricing, or their conduct. Any contract, engagement, or transaction between you and a marketing partner is strictly between you and that partner.
We make no representation that any particular partner will contact you, will provide a satisfactory quote, will be available in your area, or will perform any service adequately. Our role is limited to providing the introduction.
The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party site or service.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, software, and arrangement thereof, is the property of Optilabx or its licensors and is protected by intellectual property laws. You may access and view the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the Site without our prior written consent.
Trademarks and brand names displayed on the Site belong to their respective owners. Display of a partner's name or logo does not imply endorsement or partnership beyond what is explicitly stated.
8. Disclaimers
ComparaHome is a lead generation service and not a home service provider. We connect homeowners with independent licensed home improvement professionals. Quote prices, scope, and contractual terms are determined solely by the providers, not by ComparaHome. Any contract, engagement, or transaction between you and a matched provider is strictly between you and that provider.
ComparaHome is not affiliated with, endorsed by, or sponsored by Facebook, Meta, Google, or any other advertising platform. Use of these platforms' names elsewhere on the Site is descriptive only and does not imply endorsement, partnership, or affiliation.
The Site and Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Optilabx disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any information on the Site. We do not warrant any result or outcome from using the Site or from engaging any marketing partner you are matched with.
Some jurisdictions do not allow certain disclaimers of warranty, so some of the above may not apply to you.
9. Limitation of Liability
To the fullest extent permitted by law, in no event shall Optilabx, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, loss of goodwill, or other intangible losses — arising out of or related to your use of the Site, your inability to use the Site, or any services provided or not provided by any marketing partner.
In any event, our aggregate liability to you for any claim arising out of or related to these Terms or the Site shall not exceed one hundred US dollars (USD $100.00). This limitation applies regardless of the cause of action or theory of liability.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Optilabx, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, (d) information you submit through the Site that is false, inaccurate, or misleading, or (e) any dispute between you and any marketing partner or third party.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Site at any time. All provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — shall survive.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law principles. If you are a consumer resident in the European Union, the United Kingdom, or a jurisdiction whose law mandates local consumer protection, that mandatory protection is preserved.
13. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved informally by contacting us at kiearan@team.optilabx.io. Most disputes can be resolved quickly and to the mutual satisfaction of both parties this way.
If we cannot resolve a dispute informally within sixty (60) days, either party may submit the dispute to the courts of England and Wales, which shall have exclusive jurisdiction.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
14. Changes to These Terms
We may revise these Terms at any time by posting an updated version on the Site with a new "Last updated" date. Material changes will be communicated via a prominent notice on the Site or, where required, by direct notification. Your continued use of the Site after any revision constitutes your acceptance of the revised Terms. If you do not agree to a revision, you must stop using the Site.
